OCUR PRIVACY POLICY

At OCUR, protecting your privacy and ensuring the security of your data are our top priorities. OCUR only collects personal data that is absolutely necessary for the performance of its tasks (data economy). This privacy policy explains how we collect, use, store, and safeguard your information when using our app.

1. Introduction

OCUR is an innovative mobile application enabling users to track and absorb their vehicle’s CO₂ emissions using advanced Direct Air Capture (DAC) technologies. By using OCUR, customers agree to these Terms and Conditions of Sale (TCS).

2. Services
2.1 Emissions Calculation
  • Internal Combustion Engine (ICE) and Hybrid Vehicles: Emissions are calculated based on standard data from the Worldwide Harmonised Light Vehicle Test Procedure (WLTP) or from the New European Driving Cycle (NEDC).
  • Electric Vehicles: Indirect emissions are determined using the energy mix of the primary country of use.
  • Vehicles Without Available Data: For vehicles without WLTP or NEDC information, OCUR guides users to estimate their emissions.
2.2 Emissions Absorption

OCUR places quarterly bulk orders with its DAC suppliers. The emissions absorption process is guaranteed within a maximum of six years from the time of order, corresponding to the performance commitment of DAC suppliers. This ensures emissions are absorbed and permanently stored within the specified timeframe.

3. Pricing and Price Revisions

All OCUR prices include applicable VAT according to local laws.

3.1 Flexible Pricing

OCUR reserves the right to adjust its prices at any time in the following cases:

  1. Changes in Technology Costs: Due to the ongoing development and scaling of Direct Air Capture (DAC) technologies, suppliers may adjust the pricing of these solutions. OCUR will update its prices accordingly to reflect these changes.
  2. Annual Update of National Energy Mix Data: The indirect emissions of electric vehicles are calculated based on the energy mix of the country where the vehicle is primarily used. These data, updated annually, may result in price adjustments if changes in the energy mix decrease or increase indirect emissions. Users will be notified of such changes in advance.
3.2 Change Notification

In the event of price changes, OCUR will notify users at least 30 days before the new prices take effect.

3.3 Commitment to Transparency

OCUR ensures clear and transparent communication regarding the reasons for price adjustments, whether linked to technology costs or environmental data updates.

4. Payments
4.1 Payment Methods

Payments are processed via Stripe or credit card. Currency conversions are based on the exchange rates at the time of payment.

4.2 Billing

Users receive a monthly or quarterly invoice summarizing their absorbed emissions and the amounts charged. Unless otherwise specified, the invoice is payable within ten days and bears interest at 5% per annum from the eleventh day.

4.3 Payment Security

OCUR ensures secure transactions through advanced encryption protocols provided by Stripe.

5. Cancellation and Termination
5.1 Right to Terminate

Users can cancel their subscription at any time via the application. Personal data will be deleted in accordance with our Privacy Policy.

5.2 Effect of Termination

Termination results in the immediate cessation of CO₂ absorption and associated services. Payments already made will not be refunded, a prorated charge for the current month will be applied, and an invoice will be issued.

6. Limitation of Liability

OCUR cannot be held liable for any delays or failures related to:

  • DAC suppliers.
  • Unforeseen variations in environmental or energy data used for emissions calculations.

OCUR may use third party services for the user's convenience. These are subject to the terms of use and privacy policies of the third party concerned. OCUR declines all responsibility for the use of third party services.

7. Data and Privacy

All personal data are managed in compliance with the Federal Act on Data Protection (FADP) and the General Data Protection Regulation (GDPR) . For more details, please refer to our Privacy Policy.

8. General Provision

OCUR reserves the right to modify and update these TCS at any time. Each new version comes into force from the date of its posting on the website.

Users are therefore invited to regularly consult the legal notice and the TCS in force at the time of access to the website.

If any of the provisions of the TCS are found to be wholly or partially invalid or ineffective, the validity and effectiveness of the remaining provisions of the TCS shall not be affected. Invalid or ineffective provisions shall be replaced by other provisions that come as close as possible to the economic meaning and purpose of the ineffective provisions.

9. Governing Law and Jurisdiction

These TCS are governed by Swiss law. In the event of a dispute, the competent courts in Sion shall have jurisdiction.

We only collect the information necessary to provide and enhance our services, including:

  • Registration Data:
    • First and last name.
    • Email address.
    • Phone number.
    • Postal address.
  • Vehicle Data:
    • Vehicle Identification Number (VIN).
    • Vehicle model details.
  • Transaction Data:
    • Order history.
    • Purchase details.
  • Payment Data:
    • Secure payment processing via Stripe.
2. Use of Data

The data collected is used to:

  • Manage your user profile and give you access to the app’s features.
  • Calculate your CO2 emissions and provide absorption solutions using Direct Air Capture (DAC) technology.
  • Track your progress and activate rewards as part of OCUR’s loyalty program.
  • Send relevant notifications :
    • Emails: Order confirmations, emission reports, special offers.
    • Push notifications: Goal reminders, updates on your actions.
  • Responding to your inquiries (customer support).
  • Fulfilling legal obligations.

We also collect and publicly display anonymised data related to vehicles registered on OCUR, allowing them to be linked to a unique QR code sent to the customer. Only the following data is made publicly accessible:

  • Vehicle brand
  • Vehicle model
  • Number of kilograms of CO2 absorbed
  • Equivalent compensated kilometers

No personally identifiable information (name, email, phone number) will be associated with or displayed alongside this data. This approach allows each owner to showcase their commitment to more sustainable mobility.

The goal is to provide transparency on the environmental impact of private mobility and to encourage collective engagement in sustainability.

This data is publicly accessible and can be viewed by anyone scanning the QR code.

3. Legal Basis for Processiong

We process your personal data based on the following legal grounds:

  • Contract performance.
  • Consent.
  • Legitimate interest, e.g. improving our services and managing customer relationships.
4. Data Not Used

To respect your privacy:

  • We do not collect or use your location data.
  • Your personal data is never shared with third parties, including partners like Climeworks. Only aggregated and anonymized data may be used for internal statistical purposes.
5. User Rights

As a user, you have the following rights:

  • Access and Rectification: View, edit, or correct your information directly through the app.
  • Data Deletion: Delete your account at any time via the app settings. Upon deletion:
    • Your personal data (name, email, phone, etc.) will be permanently erased, subject to legal exceptions.
    • Only your vehicle’s VIN and the CO2 absorbed will remain stored in an anonymized format, unrelated to your identity.
    • Any removal of a vehicle from the OCUR garage and any account deletion will result in the removal of public links associated with QR codes.
  • Restrict Processing: Request the restriction of the processing of your personal data in certain circumstances.
  • Right to Object: Object to the processing of your personal data on legitimate grounds.
6. Secure Payments via Stripe

All payments made on OCUR are processed through Stripe, a platform compliant with the Payment Card Industry Data Security Standard (PCI-DSS). This ensures your payment information is protected and never accessible to OCUR.

7. Data Security

We have implemented strict measures to protect your data:

  • Encryption: All sensitive data is encrypted at every stage.
  • Restricted Access: Only authorized employees can access your information, and only as required for their duties.
  • Compliance Standards: Data is stored in ISO-compliant data centers.
  • Retention: We retain your personal data for as long as necessary to manage the business relationship and in accordance with legal obligations regarding the retention of commercial and tax documents.
8. Legal Compliance

OCUR fully complies with:

  • The GDPR (General Data Protection Regulation) for users in the European Union.
  • The FADP (Swiss Federal Act on Data Protection) for users in Switzerland.
9. Account Deletion

Deleting your account will result in:

  • Immediate deletion of your personal data (name, address, etc.), subject to legal exceptions.
  • Retention of anonymized data only, necessary to ensure transparency in emission and absorption calculations.
